European settlement of Australia commenced in 1788. Prior to this, Indigenous Australians inhabited the continent and had unwritten legal codes Terra Nullius: Terra Nullius: A Latin term which translates as Empty Land or Nobody s Land . Captain Cook declared Australia to be Terra Nullius when he sailed into Botany Bay on April 28th 1770, so that he could claim Australia for Britain. This proclamation ignored the fact that hundreds of different groups of Indigenous people occupied the land. The indigenous people did not have any form of political organisation. The British could not find any recognised leaders with authority so they couldnââ¬â¢t sign treaties. If the Crown (and therefore the State government) already owned the land then why would it have to buy some from the Indigenous inhabitants? Again, why establish a court to make judgements if the land belonged to the Crown? On 3rd June 1992 six of the seven High Court Judges ruled; The Meriam people are entitled as against the whole world, to possession, occupation, use and enjoyment of the lands of the Murray Islands On June 3rd 1992, six months after Eddie Koiki Mabo s tragic death, the High Court upheld his claim that Murray Islanders held native title to land in the Torres Strait. Mabo v Queensland [No 2] (1992) 175 CLR 1 (Mabo) declared that terra nullius had never legally existed and that it had been wrongfully applied to Australia. The high court said that ultimate title existed instead, and through that, native title could be claimed. To this day Cromwell is a divisive figure, who we can either consider a brutal military dictator, a liberal hero for religious toleration, or a class revolutionary supporting political freedoms and fighting back against the ruling aristocracy. However, when all is considered, it is evident that despite inspiring the beginnings of a more democratic England, he was a merciless and suppressive ruler who hypocritically became King in all ways but name.Firstly, Oliver Cromwell can be seen as a brutal military dictator. This can be seen by his attitude to Ireland, where his solution as leader of the English Parliamentary forces to the issue of the lack of support for the new republic (the Commonwealth of England, Scotland and Ireland) was to crush the unrest and massacre Irish citizens. This meant that whilst many favoured a protestant stance for Britain, many also disagreed with the enforcement of religious policies on the nation. During Cromwells rule there certainly was more religious toleration than Britain was accustomed to under Charles, however there were still many areas where social groups were not tolerated, and he did charge those who abused this liberty were subjected to regulation. There was still a state church, however it was not compulsory to attend, and private worship was largely tolerated. The first Civil Ceremony marriages were conducted in England, and the new government did not dictate policies on rites, ceremonies and sacraments. Many churches were left to decide how they wished to administer baptisms or the Lords Supper as long as they largely followed Protestant godly teachings.
